Your use of any information or materials on the service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the service meet your specific requirements.
The service contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
All trade marks reproduced in the service which are not the property of, or licensed to, the operator are acknowledged on the website. Unauthorised use of the service may give rise to a claim for damages and/or be a criminal offense.
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or any other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
Currently, the service provides payment by Paypal and credit card through Stripe. These methods process online transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. Payments are fully automated with an immediate response.
Your complete credit card number cannot be viewed by us or any outside party. All transactions are performed under 128 Bit SSL Certificate. All transaction data is encrypted for storage.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
After making a payment and creating your test plan, the email account you nominate will receive information from us and we will be in contact with you via email to provide links to your videos and final test results
All test results will be available within three business days of payments.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
Refunds and Cancelations
As testing often occurs immediately upon receipt of payment, we are unable to provide cancelations once payment has been made.
We do not normally provide refunds upon delivery of test results, however, if you are not satisfied with the service for whatever reason please email us at firstname.lastname@example.org with details of your issue and we will attempt to resolve the matter.
If you would like to enquire about any unusual circumstance that you believe may warrant a refund outside of the terms stated herein please contact us.
Privacy and Confidentiality Statement
We are committed to protecting your privacy. Only authorised employees within the company on a need to know basis, use any information collected from individual customers. We constantly review our systems and data to keep personal information secure, accurate and up-to-date.
We only collect personal information during the booking or signup processes and use this information to provide you with products or services directly related to your booking with TestMate or to market these products or services to you.
Client records are regarded as confidential and therefore, will not be divulged to any third party, other than [our manufacturer/supplier(s) and] if legally required to do so to the appropriate authorities.
Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Clients with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by TestMate will only be in connection with the provision of agreed services and products.
Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Contests, Sweepstakes and Promotions
Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

In no event shall TestMate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
